Divorce and Financial Disputes on Divorce

DivorceDivorce is the legal process that will bring a marriage to an end. A person must have been married for at least a year in order to apply for a divorce. Very often there are children and financial disputes that need to be dealt with as a result.

MediationFamily mediation is a voluntary process that enables separating couples to resolve their disputes without going to a family court. The goal of Mediation is to assist separating and divorcing couples to make arrangements for their children and in relation to finances.

Collaborative Law

Collaborative LawCollaborative Law is a non-confrontational way of resolving issues arising from relationship breakdown. The aim of this approach is to resolve family disputes without having to attend court.

Cohabitation

CohabitationIn contrast to married couples, cohabiting couples have no legal obligations towards one another that arise from their relationship, except in relation to common children. However, it is usually on separation that unmarried couples become, often painfully, aware of the limited legal rights they have.

It is strongly recommended to seek independent legal advice from a Family solicitor before living together in order to be fully aware of what rights each partner has and how to protect them.

Dissolution of Civil Partnerships

Dissolution of Civil PartnershipsAlthough dissolution is a process that legally terminates a Civil Partnership, other issues arising as a result, such as child maintenance and financial disputes will have a separate procedure. In order to apply for dissolution a person must have been in a Civil Partnership for at least a year.

Domestic Violence

Domestic ViolenceVerbal abuse, physical aggression or assault, sexual abuse, neglect, emotional manipulation and financial control are just some of the behaviours classified as domestic violence. Domestic abuse can happen amongst married, dating and cohabiting couples.

Pre- and Posnuptial Agreements

Pre- & Postnuptial AgreementsPrenuptial agreements, similarly to precivil partnership agreements, set out what should happen to a couple’s assets in the event their marriage or civil partnership breaks down. Postnuptial agreements deal with the same issues but are taken out during marriage or civil partnership rather than before.

It is essential to follow legal requirements when signing these agreements hence downloading a prenuptial contract without specialist legal knowledge of a Family solicitor can disadvantage either party at a later date.
